The provision takes effect immediately — but it does come with some stipulations. In order to be provided the postponement, women will need to submit a note from a physician proving they are breastfeeding. Also, mothers who have previously postponed or excused their jury duty cannot use the provision. Luckily I was able to appear in court the morning I was called for jury duty because both girls were in preschool that day. However there was no one to pick them up for me in the early afternoon or take care of them after school. I just wrote a letter explaining our situation and I was excused.

She can ask, but she does not have a right to be excused
Laptop computers and cell phones are not allowed in the courtroom - please do not bring them into the courthouse. If they are brought to the courthouse, they will be checked at the door and you will be requested to leave these items with Security until you are released for the day. Public phones are available throughout the Rochester Courthouse only. While no formal dress code exists, jurors are requested to dress in a manner respectful to the Court.
You need to make a request to defer your jury service in writing using the back of the jury qualification questionnaire. Please give the reason why you need to be deferred and when would be a better time for your to serve as a juror within a 6-month period. The questionnaire still needs to be completed and returned to the Court.
| Other Jury Duty Excuses in New York
Hope they excuse you, it's pretty cruddy if they don't given your DH would lose pay that your family depends on. Florida has an exception for caregivers of young children. I just checked a box and sent in my card. If you don't see that option, call and see if your state has an exception.
You will be mailed a summons form with a date to report and a qualification questionnaire to complete and return within ten days to the Court. The courts use several sources, not just voter roles, to select jurors. So this method would not only deprive us of your important point of view in upcoming elections (I hope by now we see how important it is to vote!), but it might not get you out of jury duty. I believe that small children and no childcare is a standard check off on the jury duty form. This may vary by court, and I know the way it is written is a bit confusing, but you should be able to apply for excusal easily, without having to go to the court at all.
There’s Still Time To Grab These Last-Minute Gifts From Target
It wasn't long ago that I dreaded getting called for jury duty as much as everyone else. We hear others complain about how annoying the process is long before we're even eligible to serve. By the time that first summons arrives, we are primed to hate it. I first served years ago, when I still lived in New York. During lunch, I roamed the crowded streets, but for the other seven hours, I sat in just-bearable chairs and read.
Evans also said she breastfeeds her youngest and homeschools her other two children. One mom told me she was excused from the very same county I was summoned for because she was breastfeeding, even though her child was 2 years old. — I considered claiming I was still nursing my infant twins, but the rules on my summons said nursing mothers were excused with a doctor’s note. This mom told me she didn’t ever have to supply one, but I didn’t take my chances.
Jurors are summoned for a 90-day term of service. However, you will not be at the Court every day for this period. You may be required to appear only one to three times. If you are selected, you will serve for the duration of the trial and be excused for the remainder of the 90-day period. If you appear for jury service and are not selected, you will not have to return again until you are notified by mail with another notice to report for jury service.
Just to be clear I do think childcare is a perfectly reasonable reason not to serve, and I believe it is widely accepted as an excuse. But after five years of diapers, cyclone tantrums, Dora the Explorer, and unpredictable food preferences, I need a break. When my older daughter was still a baby, I read some advice in a parenting magazine. It suggested that I get a comfortable armchair and set it up facing a wall. Once a day, I was told, I should make myself a cup of tea -- herbal, of course -- and sit in my chair for 20 minutes, my back to the noise and chaos. This, I was advised, would be a way to find serenity, to claim some time for myself.
The eight year excuse period observed by NY State does not apply in U.S. If you are selected to serve on a Grand Jury, you are empanelled for a term of 12 months. That period of time may be extended for an additional 6 months. Do not worry, absolutely nothing will happen. Sadly, lots of people ignore jury notices, and there is no enforcement mechanism.
The Court’s schedule sometimes changes at the last minute. Rather than have you sit in the jury room all day, we may change your day to report. It is, therefore, important to call the telephone number printed on your summons or notice on the evening or weekend before the summons date. You will hear a recorded message giving detailed reporting instructions.
She told the judge she’s a doctor, and he told her she could afford child care. In my experience, they have a box to check on the jury summons card if you are the sole caregiver of a dependent . They ask you give a detailed explanation in a note below the check box, which worked twice for me. I told them I was a nursing mother and let them imagine both of us showing up for duty.
